1. Preamble

These General Terms and Conditions of Sale (GTCS) apply to all sales made on the website www.help-humidite.com, operated by:

By validating their order, the customer acknowledges having read and accepted these GTCS.

2. Mandatory technical recommendations

Products concerned: ATE and ATG (polarity inverters)

Installation

The installation of the devices must strictly comply with the technical and installation manuals provided, as well as all recommendations specific to each model.
➡️ This conditions the effectiveness of the treatment and the maintenance of the warranty.

Stripping the base of the walls

During the drying phase, it is recommended to strip the base of the walls (10 cm above the degraded area) to promote moisture evaporation.

Home ventilation

Good air renewal is essential:

  • Doors undercut by 1.5 cm in dry rooms

  • 2 cm in wet rooms

  • Mechanical or natural ventilation compliant with current standards

Surface restoration

Once the walls are dry:

  • Brush the surfaces to remove hygroscopic salts

  • Reapply lime-based plaster with a recommended anti-salt additive

Additional drainage

In case of lateral infiltration or underground moisture, a perimeter drain is recommended to prevent water from reaching the foundations.

3. Process limitations

This process does not allow treatment of:

  • Direct infiltration

  • Flooding

  • Existing mold

These issues must be treated separately using appropriate means.

4. No-results warranty clause

Important information – Please read carefully

The wall drying speed depends on several factors:

  • wall thickness,

  • its composition,

  • the applied coating,

  • and strict compliance with the technical recommendations provided by Help Humidité.

The customer acknowledges that strictly following the recommendations is mandatory to ensure product effectiveness.
Any failure to comply may lead to warranty loss.

Our products are sold with a no-results warranty clause: although we offer high-quality devices, results may vary depending on environmental conditions and proper use of the device.

In case of incorrect installation or use, responsibility lies entirely with the customer.

5. Liability

Installation and use

The customer is responsible for installing their device.
We provide complete documentation to support this step, but any failure to follow the recommendations may result in:

  • Warranty loss

  • No results

  • Release of Help Humidité from liability in the event of malfunction

6. Right of withdrawal and refunds

In accordance with the law, the customer has a legal 14-day withdrawal period after receiving the product, during which they may request a refund without justification.

After this period:

No return or refund can be accepted, except as required by law.

Article 1 – Principles

These general terms and conditions express the entire obligations of the parties. In this sense, the buyer is deemed to accept them without reservation.

These general terms and conditions of sale apply to the exclusion of any other conditions, particularly those applicable to in-store sales or through other distribution and marketing channels.

They are accessible on the Help Humidité website and shall prevail, where applicable, over any other version or contradictory document.

The seller and the buyer agree that these general terms and conditions exclusively govern their relationship. The seller reserves the right to modify its general terms and conditions from time to time, which shall apply as soon as they are published online.

In the event of any omission in the terms of sale, they shall be governed by the customary practices in the distance-selling sector for companies whose registered office is in France.

These GTCS enter into force on the date the order is validated and apply until the expiry of the warranties and obligations owed by the seller.

Article 2 – Content

These general terms and conditions define the rights and obligations of the parties within the framework of the online sale of goods offered by Help Humidité to the buyer via its website.

These conditions apply only to purchases made on https://www.help-humidite.com and delivered in mainland France and in European countries.
For delivery to the French overseas territories (DOM-TOM) or outside Europe, please send a message to the following email address: help.humidite@gmail.com.

Products concerned: moisture control products.

Article 3 – Pre-contractual information

The buyer acknowledges having been informed, in a legible and understandable manner, before placing their order and entering into the contract, of these general terms and conditions and of the following information:

  • The essential characteristics of the goods;

  • The price of the goods and/or how the price is calculated;

  • Any additional transport, delivery, or postage costs;

  • If the contract is not performed immediately, the delivery date or timeframe;

  • Information relating to the seller’s identity and its postal, electronic, and telephone contact details.

Article 4 – The order

The buyer may place an order online, from the online catalog and via the available form, subject to available stock.

The buyer will be informed of any product unavailability.

To validate the order, the buyer must accept these general terms and conditions by clicking where indicated, choose the delivery address and the payment method.
The sale will be considered final after confirmation by the seller via email and receipt of the full order amount.

Article 5 – Electronic signature

Providing the buyer’s bank card number online and final validation of the order constitute proof of the buyer’s agreement regarding:

  • The amounts due under the order;

  • The signature and express acceptance of the transactions carried out.

In the event of fraudulent use of the bank card, the buyer is invited to contact Help Humidité immediately.

Article 6 – Order confirmation

The seller provides the buyer with an order confirmation by email.

Article 7 – Proof of the transaction

Computerized records, kept in the seller’s IT systems under reasonable security conditions, are considered proof of communications, orders, and payments made between the parties.

Article 8 – Product information

The products governed by these GTCS are those shown on the Help Humidité website. They are offered within the limits of available stock and described as accurately as possible.
However, errors or omissions may occur without the seller’s liability being incurred.

Article 9 – Prices

The seller reserves the right to modify its prices at any time, but undertakes to apply the prices in force at the time of the order, subject to availability.
Prices are expressed in euros and include VAT.

Article 10 – Payment terms

The order implies immediate payment.
The buyer may pay by bank card, PayPal, cheque, or bank transfer.
Payment is made in full on the day the order is placed.

Article 11 – Product availability – Refund – Cancellation

Products are delivered within a maximum of 15 days for deliveries in mainland France and in all European countries, according to the defined terms.
In the event of late delivery, the buyer may cancel the order and will be refunded within 14 days.

Article 12 – Delivery terms

Delivery means the transfer of physical possession of the goods to the buyer.
The ordered products are delivered to the address provided by the buyer when placing the order.

Deliveries are made by an independent carrier, and delivery costs are borne by the buyer, unless otherwise stated on the website at the time of ordering.

If the buyer is absent at the time of delivery, a delivery notice will be left, and the buyer must contact the carrier to arrange a new delivery date.

Article 13 – Delivery errors

The buyer must notify the seller of any delivery error or non-conformity of the products received compared to the information shown in the order confirmation, within 3 business days following receipt of the order.
Any claim made after this period will be rejected.

In the event of a delivery error or non-conformity, the product to be exchanged or refunded must be returned to the seller in its original condition, unused, with all delivered elements (accessories, packaging, manual, etc.).

Article 14 – Transfer of risks

The risks of loss or damage to the products are transferred to the buyer at the moment the buyer, or a third party designated by them other than the carrier, physically takes possession of the goods.

Article 15 – Product warranty

All products supplied by Help Humidité benefit from the legal warranty of conformity and the warranty against hidden defects, in accordance with Articles 1641 et seq. of the French Civil Code.

In the event of non-conformity of a product sold, it may be returned, exchanged, or refunded.

All complaints, exchange requests, or refund requests must be made by post to 12 Place des Grands Hommes, 33000 Bordeaux or by email to help.humidite@gmail.com, within 14 days from receipt.

Article 16 – Right of withdrawal

The buyer has a period of 14 calendar days to exercise their right of withdrawal without having to justify any reason or pay penalties.
The period runs from receipt of the products.

The buyer must notify their decision to withdraw by email to help.humidite@gmail.com.
Products must be returned in their original condition, unused, with all delivered elements (accessories, packaging, manual, etc.).

Return shipping costs are borne by the buyer.
The refund will be made within 14 days following receipt of the returned products.

Article 17 – Intellectual property

All elements of the Help Humidité website, whether visual or audio, are protected by copyright, trademarks, or patents.
They are the exclusive property of Help Humidité.
Any total or partial reproduction of these elements, regardless of the medium, without the prior express authorization of Help Humidité, is prohibited and would constitute infringement punishable under the Intellectual Property Code.

Article 18 – Personal data protection

The information requested from the buyer is necessary to process the order and may be communicated to Help Humidité’s contractual partners involved in fulfilling the order.
Such data may also be used for commercial prospecting purposes.

In accordance with the French “Informatique et Libertés” law of January 6, 1978 as amended and the General Data Protection Regulation (GDPR), the buyer has the right to access, modify, rectify, and delete their personal data.

Article 19 – Force majeure

Any circumstances beyond the parties’ control preventing performance under normal conditions are considered causes of exemption and result in suspension of obligations.

Force majeure events include, in particular: war, riot, fire, strike, accident, natural disasters.

Article 20 – Dispute resolution

These general terms and conditions of sale are governed by French law.
In the event of a dispute or complaint, the buyer will first contact the seller to seek an amicable solution.

Failing an amicable agreement, the parties will refer the matter to the competent courts of the seller’s registered office location.

Article 21 – Acceptance of the GTCS

By validating their order on the Help Humidité website, the buyer acknowledges having read, understood, and accepted without reservation all of these general terms and conditions of sale.
These GTCS constitute the entirety of the parties’ rights and obligations regarding the purchase and sale of products on the website.

No special condition communicated by the buyer, unless formally accepted in writing by the seller, may prevail over these GTCS.

Article 22 – Amendment of the GTCS

The seller reserves the right to amend these general terms and conditions of sale at any time.
The new GTCS will apply to orders placed after they are published online.

Article 23 – Personal data protection

Article 26 – Archiving and proof

The seller will archive order forms and invoices on a reliable and durable medium constituting a faithful copy, in accordance with the provisions of Article 1348 of the French Civil Code.

Help Humidité’s computerized records will be considered by the parties as proof of communications, orders, payments, and transactions made between them.

Article 27 – Entire agreement

These general terms and conditions express the entire obligations of the parties.
No general or specific condition communicated by the buyer may be incorporated into these GTCS, except with the seller’s formal written acceptance.

If one or more provisions of these terms are deemed invalid or declared as such under a law or regulation, or following a final decision of a competent court, the other provisions shall remain in full force and effect.

Article 28 – Acceptance of the general terms

The buyer acknowledges having read these general terms and conditions of sale and declares that they accept them without reservation.

Validation of the order on the website help-humidite.com constitutes acceptance of these GTCS, which will apply for the entire time necessary to supply the ordered products and until the expiry of the warranties.
